Terms of Service

Last updated: March 22, 2025

These Terms apply to everyone who uses Savorini in Canada. Some sections apply only to Customers (people who create an account to discover and redeem deals) or only to Partners (businesses and their representatives who apply to list venues or offers on Savorini).

1. Acceptance of Terms

By accessing or using Savorini ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. If you are accepting on behalf of a company or other legal entity (for example, as a Partner), you represent that you have authority to bind that entity.

2. Eligibility and Age (Canada)

The Service is offered in Canada. You must be of legal age to purchase alcohol in your province or territory of residence (18 or 19, depending on where you live) to use features related to alcoholic beverages. By using the Service, you represent and warrant that you meet this requirement. We may verify age and may suspend or terminate accounts that do not comply.

Partners: The person submitting a partner application must be authorized to act for the business and must be at least the age of majority in their province or territory.

3. Customer Accounts

Applies to Customers. When you create a customer account, you must provide accurate, complete, and current information. You are responsible for safeguarding your login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

One person or household should not maintain multiple accounts to abuse promotions, circumvent limits, or defraud venues or Savorini.

4. Partner Applications and Partner Accounts

Applies to Partners. If you submit a partner or venue application through our site, you agree that the information you provide may be used to evaluate and contact you about the opportunity, as described in our Privacy Policy. Submitting an application does not guarantee acceptance. If we onboard you, additional terms (for example, a venue or partner agreement, fee schedule, or brand guidelines) may apply and will govern the commercial relationship to the extent they conflict with these general Terms.

Partners are responsible for offers, pricing, staffing, licensing, and compliance with applicable laws (including liquor licensing and advertising rules in their province or territory). You will not misrepresent your business or offers on Savorini.

5. Deal Redemption

Deals are provided by participating venues and are subject to availability and each venue's own terms. Savorini does not guarantee that any deal will be available or honoured. Provincial and territorial rules apply to alcohol service and promotions.

  • Deals may need to be activated in the app before redemption, where the product supports it
  • Limits (for example, one per person per visit) apply as stated on the offer
  • Venues may refuse service in line with law and house policy
  • Offers may not be combinable unless stated
  • Valid government-issued ID may be required for age-restricted purchases

6. User Conduct

You agree not to use the Service to:

  • Violate any applicable federal, provincial, territorial, or municipal law or regulation
  • Post false, inaccurate, misleading, or defamatory content
  • Impersonate any person or misrepresent your affiliation with a business
  • Harass, abuse, or harm another person
  • Attempt unauthorized access to the Service, other accounts, or our systems
  • Scrape, data-mine, or use the Service to compete with or replicate Savorini without our consent

Customers must not use the Service for unauthorized commercial resale of offers. Partners may use business features only as permitted under our partner onboarding and any separate agreement.

7. Reviews and Content

Users may post reviews or other content. You grant Savorini a non-exclusive, royalty-free, worldwide licence to host, use, modify, and display that content in connection with the Service. You retain ownership of your content subject to that licence.

We may remove content that violates these Terms or that we reasonably consider inappropriate, unlawful, or harmful.

8. Intellectual Property

The Service and its branding, software, and original content are owned by Savorini or its licensors and are protected by copyright, trademark, and other intellectual property laws in Canada and elsewhere.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law in Canada, Savorini disclaims all warranties and conditions of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. Some provinces do not allow certain disclaimers; in those cases, disclaimers apply only to the extent permitted.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Savorini and its directors, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from the Service is limited to the greater of one hundred Canadian dollars (CAD $100) or the amounts you paid to Savorini for the Service in the twelve (12) months before the claim, except where limitation is prohibited by law (including consumer protection laws in your province or territory).

11. Indemnification

You agree to indemnify and hold harmless Savorini and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms, except to the extent caused by Savorini's gross negligence or wilful misconduct.

12. Changes to Terms

We may modify these Terms. We will post the updated Terms on this page and update the "Last updated" date. Where required by law, we will provide additional notice. Continued use after changes become effective constitutes acceptance, except where your explicit consent is required.

13. Termination

We may suspend or terminate access to the Service for breach of these Terms or for legal, security, or operational reasons. You may stop using the Service at any time. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of Canada and the Province of Ontario, without regard to conflict of law principles, except that mandatory consumer protection rules in your province or territory of residence may still apply to you as a consumer where they cannot be waived.

You agree that the courts of Ontario have exclusive jurisdiction over disputes arising from these Terms, subject to any right you may have under applicable law to bring proceedings in your home province or territory.
